Common Legal Claims
Having some knowledge or understanding about common legal claims can work to your advantage. It will help you avoid falling victim to legal claims and know when you should file for one. In whichever case, you should also hire an experienced lawyer whenever you are involved in a legal claim. Even if you have good knowledge of the law, representing yourself is always not the best idea as it minimizes the chances of the lawsuit going your way. Below are some of the common legal claims.
Contract Claims
Contract claims are those made when one or more terms of a contract are breached. They apply to any legal and valid agreement, whether oral, written, or implied. The claims are typically made if the breached terms of the contract have led to a direct or indirect monetary loss. The compensations are usually dependent on what was stated in the agreement. For cases where the contract did not specify the terms of compensation, a significant scope of dispute usually arises and is settled by the law courts.
Tort Claims
A majority of tort claims usually arise from negligence that results in loss or injury. Negligence is the principle where someone fails to act with care, resulting in damage or loss to another person. Tort claims are usually made so that the negligent person compensates the affected person. The most common tort claims are typically related to personal injury. A good example is when a person gets physical injuries and financial loss after a car accident caused by another person’s careless driving. Tort law can cover damage to property, goods, and reputation.
Environmental-Based Claims
As the name suggests, these are claims filed when individuals or groups of individuals are affected by the environment because of the actions of corporates or other entities. For example, you can file lawsuits against a company that fails to dispose of its waste products correctly if the waste products cause harm to you or your community in any way. The same also applies if the environmental actions interfere with any human rights in any way.
Professional Malpractice
Professional malpractice is another common legal claim. The claim can be filed when a professional like a doctor or a lawyer fails to use his profession’s relevant and necessary skills, resulting in you being harmed or suffering monetary loss. In other words, the incompetence of a professional can lead to a legal claim.
